Welcome to Okushon Pty Ltd (“we”, “us”, “our”, “Okushon”). By accessing or using our platform, you agree to comply with these Terms of Use. Please read them carefully.

If you do not agree to these Terms, you must not use our platform.

1. Access and Use

  • Bidding: Access to bid on ad spaces is free of charge.
    Listings and Advanced
  • Features: Creating listings and accessing premium features requires payment.

We reserve the right to modify or suspend access to certain features without notice.

2. User Conduct

You agree that you will not:

  • Create false listings or fake bids.
  • Create fake accounts.
  • Upload, share, or promote content that infringes any intellectual property rights.
  • Upload, share, or promote content that is offensive, defamatory, obscene, or otherwise inappropriate.

We may suspend or terminate your account at our discretion if you violate these rules.

3. User Content

  • You retain ownership of all content you upload to Okushon.
  • By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content as necessary to facilitate auctions and promote your ad space or brand on the platform.
  • You warrant that you have all necessary rights and permissions to upload and grant the above licence for the content you provide.

4. Payments and Refunds

  • Payments are required for listing ad spaces and accessing advanced platform features.
  • All payments are processed by third-party payment providers.
  • Refund Policy: Payments are non-refundable except under exceptional circumstances, subject to Okushon’s direct review and approval.

5. Account Termination

We reserve the right to suspend or terminate your access to the platform at any time, without notice, if:

  • You breach these Terms,
  • Your use of the platform is deemed harmful to Okushon, other users, or the platform’s reputation, or
  • It is necessary to comply with legal obligations.

6. Intellectual Property

All rights, title, and interest in and to the Okushon platform (excluding user-uploaded content) are and remain the exclusive property of Okushon Pty Ltd.

You may not copy, modify, distribute, sell, or lease any part of our platform without our written permission.

7. Disclaimers

We provide the platform on an “as is” and “as available” basis.

We do not guarantee:

  • The accuracy or quality of any listings or user-generated content,
  • Continuous, uninterrupted access to the platform, or
  • That the platform will be error-free or secure.

You use the platform at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Okushon will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the platform.

9. Changes to These Terms

We may update these Terms from time to time. Updates will take effect immediately upon posting. Your continued use of the platform constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of the platform.
